Read Terminz's Data Processing Agreement (DPA) and legal documents

This page explains who at Terminz processes which data and on what basis. You can find it in the menu under Settings → Account & data → Data processing (/manager/settings/data-processing). There are no settings to configure and nothing to save here. The page consists of four sections.

Contracting Parties

There are two levels when it comes to your customers' data:

  • Data Controller: “Your business”. You decide what customer data you collect in your customer file and for what purpose—such as appointments, notes, photos on your site, and your own contact information for a person. You are responsible for informing your customers and obtaining their consent for published photos.
  • Processor: Bornwerk UG (limited liability). Bornwerk processes your customer file exclusively according to your instructions to operate Terminz for you: hosting, backups, support. Terminz itself manages a person's Terminz profile. You can only see what the person shares with you.

Data Processing Agreement (Art. 28 GDPR)

The DPA is part of your contract. The document lists eight obligations of Terminz:

  • Processing exclusively in accordance with your documented instructions;
  • Obligation of all personnel involved to maintain confidentiality;
  • Technical and organizational measures in accordance with Art. 32 GDPR;
  • Advance notice 30 days prior to the engagement of a new or replacement subcontractor, with the right to object;
  • Assistance with requests for access, erasure, and data portability;
  • Notification to you as soon as Terminz becomes aware of a data breach;
  • Erasure or return of all data upon termination of the contract, at your discretion;
  • Provision of evidence upon request and a right to audit if the evidence is insufficient.

The Open the agreement and sub-processor list button opens the full contract on terminz.com (/dpa) in a new tab.

Error Monitoring

To enable Terminz to detect issues, the application automatically reports technical errors to an error tracker (Sentry, processed in the EU). The site distinguishes between what works and what doesn't:

  • What is sent: the name of the failed operation, an error code, and the page template without identifiers, for example /kunden/:id.
  • What is not sent: content from the application, user inputs, and server error messages; names, contact information, search terms, and IP address; session logs—nothing is stored on the device.

The legal basis is the legitimate interest in ensuring trouble-free operation (Art. 6(1)(f) GDPR). You may object at any time pursuant to Art. 21(1) GDPR by sending an email to datenschutz@terminz.com.

Legal Documents

Four links open the binding versions on terminz.com in a new tab: “Privacy”, “Data processing agreement”, “Terms and conditions”, and “Legal notice”. These are Terminz's documents, not those of your location. You can manage the legal texts for your own public page under Settings → Account & Data → Legal (see “Upload your legal notice, privacy policy, and terms of service”).

Frequently Asked Questions

Do I have to sign the General Terms and Conditions (AVV)? There is no signature field or “Agree” button on this page. It describes the contract that is part of your agreement with Terminz.

Where can I see the list of subcontractors? In the General Terms and Conditions (AVV) itself, via Open the agreement and sub-processor list.

Where do I enter my own legal notice? Not here, but under Settings → Account & Data → Legal.
